1. Agreement to Terms
By downloading, installing, or using XPLR ("the App"), you agree to be bound by these Terms of Service ("Terms"). The App is operated by Zeroth ("we," "us," or "our"). If you do not agree to these Terms, do not use the App.
2. Account Registration
- You must be at least 13 years of age to create an account and use XPLR.
- You are responsible for maintaining the security of your account credentials.
- You may only maintain one account per person.
- You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
- You may sign up with an email and password, through Apple Sign-In, or through Google Sign-In.
- You are responsible for all activity that occurs under your account. Notify us immediately at support@goxplr.app if you suspect unauthorized use.
3. XPLR Pro Subscription
XPLR offers a premium subscription ("XPLR Pro") that unlocks additional features, including unlimited offline map downloads, private and shareable custom maps, and full access to federal public land boundaries.
- XPLR Pro is available as a monthly or annual subscription.
- Payment is processed through the Apple App Store or Google Play Store. We do not directly collect or store your payment information.
- Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your device's subscription settings (Apple: Settings > Apple ID > Subscriptions; Google: Play Store > Subscriptions).
- Refunds are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.
- We reserve the right to change subscription pricing. Existing subscribers will be notified before any price change takes effect on their next renewal.
4. User Content
"User Content" refers to any content you create, upload, or share through XPLR, including check-ins, spots, posts, photos, comments, maps, and trip plans.
- Ownership. You retain ownership of User Content you create.
- License. By posting User Content, you grant Zeroth a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the App and for promoting the App. This license ends when you delete your content or account, except where your content has been shared with others and they have not deleted it.
- Responsibility. You are solely responsible for User Content you post. You represent that you have the rights to share any content you upload and that your content does not violate any third party's rights.
- Removal. We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.
5. Acceptable Use
You agree not to:
- Harass, abuse, threaten, or intimidate other users
- Post false, misleading, or inaccurate information about locations or other content
- Post profane, obscene, or offensive content
- Spam, advertise, or engage in commercial solicitation
- Impersonate any person or entity
- Attempt to gain unauthorized access to other users' accounts or our systems
- Use automated tools, bots, or scripts to access or scrape the App
- Interfere with or disrupt the App's operation or infrastructure
- Upload malicious code, viruses, or harmful data
- Use the App for any illegal purpose
We reserve the right to investigate and take appropriate action against anyone who violates these rules, including suspending or terminating accounts and reporting to law enforcement.
6. Intellectual Property
- The XPLR name, logo, and app design are the property of Zeroth. You may not use our trademarks without prior written permission.
- Campground and public land data within the App is sourced from public databases including Recreation.gov and OpenStreetMap, as well as user contributions.
- Map data is provided by Mapbox and Apple Maps, each subject to their own terms of use.
- All other App content, features, and functionality (excluding User Content) are owned by Zeroth and protected by copyright, trademark, and other intellectual property laws.
7. Disclaimers
- Campground and location information is provided "as is." Information about campgrounds, rest areas, truck stops, public lands, and other locations may be inaccurate, incomplete, or outdated. Always verify conditions, availability, and safety before visiting any location.
- Location accuracy is not guaranteed. GPS coordinates, distance calculations, and public land boundary data are approximate and may contain errors.
- We are not responsible for conditions at physical locations. XPLR is a discovery tool. We do not own, operate, or manage any campgrounds, rest areas, or public lands shown in the App. Visit at your own risk.
- User-generated content may be inaccurate. Spots, reviews, and other content created by users reflect their personal experiences and opinions. We do not verify the accuracy of user-generated content.
- THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZEROTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.
9. Indemnification
You agree to indemnify, defend, and hold harmless Zeroth and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your User Content, or your violation of these Terms.
10. Account Termination
- We may suspend or terminate your account at any time if you violate these Terms, with or without notice.
- You may delete your account at any time from the App's settings. Account deletion is permanent and removes all your data, including your profile, check-ins, posts, photos, XP, and any other content. This action cannot be undone.
- If your account is terminated, any active XPLR Pro subscription must be cancelled separately through your device's subscription settings to avoid continued billing.
11. XP and Gamification
- XP (experience points) are earned through activities within the App, including check-ins, photo uploads, and spot creation.
- XP has no monetary value and cannot be transferred, exchanged, or redeemed for cash or any other form of compensation.
- We reserve the right to modify the XP system, including point values and earning methods, at any time.
- Leaderboard rankings are based on XP and are provided for entertainment purposes.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of XPLR after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the App.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of California.
